Statement of claim:

Submission of claim:
Once the statement is done, it then submitted to the court by using an online system. And when the case management department in the family court receives the claim, they study the claim in detail. Following this, the court will further require clarification by the Claimant and this clarification will include all the facts, contact details of all parties, and all other essential information for the claim to proceed.
Notification process:
It is the most crucial yet challenging part of the process. This is the most lengthy and time-consuming step in the whole process, and it takes 30 to 40% of the time from the entire case. And when it comes to filing a case, the clerk of the court is responsible for issuing summons for service of the court proceedings. The summons issued by the clerk is then signed by the court.
Memos process:
Once the process of notification of the parties is done, the process of exchanging memos starts. The starting memo is submitted by the family solicitor or by the Claimant to the court. And once it is done, one of two things will happen. Firstly, the respondent requires extra time from the court in order to study the claim, or the respondent might need some time in order to appoint a lawyer. Secondly, the family law lawyer will ask the Claimant to study the file which has attended the first hearing.
